Any unauthorized use of the services or its content may violate copyright, trademark, and other laws, and could result in criminal or civil penalties. 6. User-Generated Content

However, by submitting User-Generated Content, you grant clodpolls a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute such content in any media.

You are solely responsible for your User-Generated Content and the consequences of submitting it. By submitting User-Generated Content, you represent and warrant that you have the necessary rights to grant the above license and that your content does not violate any third-party rights, including intellectual property rights or privacy rights.

clodpolls reserves the right to remove or modify any User-Generated Content at our sole discretion, without notice, for any reason, including if we believe that such content violates these Terms or is otherwise objectionable.

7. Payment Terms

In no event shall clodpolls’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, clodpolls’s liability is limited to the fullest extent permitted by law.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. clodpolls may terminate these Terms and your access to the services at any time, without notice, for any reason, including if we believe that you have violated these Terms or engaged in any prohibited activities.

Upon termination, your right to use the services will immediately cease, and you must cease all use of the services. All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of these Terms does not affect any rights or obligations that have accrued prior to the termination date.
